Georgia’s Garnishment Process Has Been Amended
On Tuesday February 7th, 2012 Gov. Nathan Deal signed law HB 683 which removed unnecessary regulation from Georgia business’s. The main purpose of this law was to grant business’s the power to file garnishment requests through authorized personnel instead of having to hire legal council. This law took effect immediately and removed a mandate from the state Supreme Court which prevented business’s from answering garnishments on their own.
Historically, human resources or payroll employees have processed garnishments for employees. Under a 2011 court decision, the state Supreme Court held that this routine task must be performed by lawyers. This legislation prevents an undue administrative burden on small businesses by eliminating the employment of lawyers to process garnishments and allowing them to be performed by authorized personnel instead.
